NOTICE OF PUBLIC HEARING


The County of El Dorado Board of Supervisors will hold a limited public hearing in the Supervisors Meeting Room, 330 Fair Lane, Placerville, CA 95667 on October 24, 2017, at 2:00 p.m., to consider the proposed modification to General Plan Measure CO-K and modifications to the proposed Oak Resources Conservation Ordinance as recommended by the Planning Commission to the Board of Supervisors. The scope of the public hearing on October 24, 2017 is limited to final non-substantive and/or procedural modifications to the General Plan Biological Resources Policy Update, Oak Resources Management Plan, and Oak Resources Conservation Ordinance (proposed Project). ​

The Board of Supervisors previously (July 18, 2017) held a public hearing on the Environmental Impact Report and the proposed Project which consists of specific revisions to biological resources objectives, policies, and implementation measures in the Conservation and Open Space Element of the County’s General Plan, adoption of an Oak Resources Management Plan (ORMP), adoption of an in-lieu fee to mitigate impacts to Oak Woodland Areas and Individual Oak Trees, and adoption of an Oak Resources Conservation Ordinance to implement the ORMP. The public hearing on the overall proposed Project was closed and remains closed. The limited public hearing On October 24, 2017 is solely for the purpose of receiving public comment on the limited non-substantive and/or procedural modifications that were recommended by staff after the close of the public hearing on the overall Project.

On September 28, 2017, the Planning Commission recommended approval to the Board of Supervisors of a proposed modification to General Plan Measure CO-K (delete reference to Objective 7.4.3 which has been eliminated) and modifications to the proposed Oak Resources Conservation Ordinance including but not limited to: adding sections for in-lieu fee appeals; security deposit requirements for on-site oak tree/oak woodland replacement plantings; and fines and other penalties for unpermitted oak removal. Other modifications include renumbering various sections, correcting typographic errors and other minor revisions. The Planning Commission’s recommendation also included additional modifications (underlined) to Section 130.39.050(J), Exemption for Personal Use, as follows: “Removal of a native oak tree, other than a Heritage Tree or individual valley oak trees and valley oak woodlands…” These recommendations are the subject of the limited public hearing before the Board of Supervisors.

On October 24, 2017, after the close of the limited public hearing, the Board of Supervisors will consider certification of the Environmental Impact Report and approval of the proposed Project.

The proposed General Plan revisions are intended to establish a program for County-wide management of impacts to biological resources and mitigation for those impacts. The proposed Project would not directly impact the environment. Instead, it would alter the way by which the County regulates and mitigates future projects that may impact the area’s biological resources. A Program Environmental Impact Report (EIR) has been prepared for the Project. The EIR, text of the proposed amendments to the General Plan policies, objectives, and implementation measures, ORMP, proposed in-lieu mitigation fee, and Oak Resources Conservation Ordinance are available for viewing at the Planning and Building Department public counter at 2850 Fairlane Court, Placerville, California. The counter is open Monday through Friday from 8:00 a.m. to 4:00 p.m. The EIR is also available online on the County website at: https://www.edcgov.us/Government/longrangeplanning/environmental/pages/biopolicyupdatedra fteir.aspx.

The proposed amendments to General Plan objectives, policies, and implementation measures would be applicable to development projects throughout the unincorporated areas of the County. The ORMP requirements would apply to development projects at or below 4,000 feet above sea level, which is the upper elevational threshold for oak woodlands. The proposed Project would not affect incorporated areas, such as Placerville and South Lake Tahoe, nor would it affect areas under federal jurisdiction, such as Tahoe National Forest. The County of El Dorado encompasses approximately 1,800 square miles that begins at the eastern edge of Sacramento County and stretches to the Nevada state line in South Lake Tahoe.

The EIR, text of the proposed amendments to the General Plan policies, objectives, and implementation measures, ORMP, proposed in-lieu mitigation fee, and Oak Resources Conservation Ordinance will be available online when the agenda for the October 24, 2017 Board meeting is posted (see Agenda Calendar: https://eldorado.legistar.com/Calendar.aspx.
