Third District Court of Appeal Rejects Ray Nutting’s Attempt to Retain His Seat on Board of Supervisors and Denies His Attempt to Stay the Special Election Set for September 9, 2014

Disgraced former Supervisor Ray Nutting sought to vacate the County decision to hold a special election on September 9th and further attempted to overrule the finding of vacancy by Superior Court Judge Timothy Buckley. Today, the Third District Court of Appeal denied Nutting’s petition and his request for stay.

On May 14, 2014, Nutting was convicted of 6 counts under the Political Reform Act for obtaining illegal loans from County employees and a County contractor. At sentencing on June 6, 2014, Judge Buckley ruled that the crimes constituted misconduct in office and ordered his seat vacant – thus removing Nutting from the Board of Supervisors. A special election is now set for September to fill that District 2 seat. Vern Pierson commented “This joint prosecution by the California Attorney General’s Office and the DA’s Office, and the District Court’s decision today, has proven once again that no one is above the law… even the politically powerful.”
